DYK: Advertising and Physical Therapy in NJ

Did you know that as a licensed physical therapist or physical therapist assistant in New Jersey, you are required by regulation to post your license number on all advertisements (including your website) if you are an owner or a partner in a physical therapy practice? 

N.J.A.C.13:39A-8.4 states that the name, identification of licensure and license number of at least one principal of the corporation are required on all advertisements. Plus, N.J.A.C. 13:39A-8.6 states that the name and license number of all owners (unless there are more than four owners) in the corporation are required to be included in public communication.

If you haven’t done so already, take a look at all forms of advertising in which you communicate with the public and make sure that your license # is clearly posted.

So how is the provision of this statute addressed by corporations that are not owned by a physical therapist? Or, is this language confirming that the legality of a non-licensed person having ownership equity in a PT corporation needs to be questioned and brought before the appropriate legal authorities?
